EACH MEMBER OF PACBA AGREES TO OBSERVE THE FOLLOWING ETHICAL STANDARDS AND SHOULD:

(a) maintain the best traditions of workmanship in construction.

(b) write all contracts and warranties such that they are fair and mutually beneficial to all parties concerned; such that they are free of ambiguities or omissions which tend to obscure contractual obligations and such that warranty and provisions are free of the capacity to mislead or deceive the customer as to the quality or longevity of the product or service. 

(c) promote high standards of honesty, integrity, and responsibility in the conduct of business by making all advertising and sales promotion factually accurate with respect to product description, performance specification, and costs/benefits analysis, and by avoiding those practices which tend to mislead or deceive the customer with respect to competitive pricing, savings claims, or the nature and significance of contracts, warranties, finance agreements, completion certificates, lien waivers, or liability and workers’ compensation insurance. 

(d) promptly acknowledge and act on all customer complaints; and in situations where complaints appear 
unreasonable to encourage the customer to institute an approved third party dispute settlement mechanism; and to honour all contractual obligations until and unless they are altered or dissolved by the mutual consent of all contractual parties, and to fulfil  these obligations in a reasonable and prompt manner that is fair to all parties concerned. 

(e) assure the cooperation and solidarity of members to maintain mutual assistance among members and to eliminate misunderstandings and all unnecessary and unfair competition, and to refrain from any act intended to restrain or suppress competition, and to thereby promote the private enterprise system.

Any complaint against a member of the Association regarding unethical practices or violations of any rules and regulations shall be investigated by the Ethics Committee. The Board of Directors upon two-third (2/3) vote of the voting members or at its sole discretion can terminate the membership of any member who has failed to adhere to the Code of Ethics of the Association or who provided false or inaccurate information on the membership application submitted by such member.
